February 12: PA Gun Laws

Following the tragedy in Newtown, CT, state legislators have responded by offering multiple bills related to state gun laws.  PCN’s guests for this discussion include Rep. Daryl Metcalfe (R-Butler), who is sponsoring a bill to make federal gun control laws unenforceable within Pennsylvania, and Sen. Larry Farnese (D-Philadelphia), who is sponsoring legislation to ban assault weapons and high-capacity ammunition.

    2 thumbs up for Rep. Daryl Metcalfe. The law abiding gun owner needs more men like you on our side. Why should law abiding gun owners suffer for the illegal actions of those who do not or will not follow the law? More restrictions to the law abiding citizen will not stop illegal activity from those that do not follow the law.

    We need better back ground checks,I agree, and also better health care for the mentally sick.

    Limiting what and how much I can use to defend family and self should be illegal. Those trying to take away my Constitutional and God given Rights should be ashamed to call themselves our leaders.

    Rep. Daryl Metcalfe deserves a metal. He seems to be the only one standing up for us law abiding gun owners. The law abiding citizens have been stepped on enough for the criminal acts a few deranged people. Thank You Rep. Metcalfe.

    The gun owners of PA. need to stand behind Rep. Metcalfe and give him all the support he needs. We need to speak to the Representatives of our own districts and make sure they vote for Bill 357 and not against it.

    As a law abiding citizen, I am made to feel like I am the criminal concerning the proposed gun control laws. That owning high capacity magazines for my firearms is wrong. The proposed gun control laws also sends a message to me that my family is not worth more than 10 bullets to defend them with in a life or death situation. God bless you Representative Metcalf for helping to defend our 2nd Amendment rights. We are behind you 100%.

Daryl Metcalfe You are one of the few that have stand up for our Constitutional and Natural rights, Rep Payne has also informed me that he stands by you on The PA House Bill 357 Right to Bear Arms Protection Act. You both have my support and greatest respect, I am a veteran and like you I have served my country. Keep up the good work, you have many supporters in our state now more than ever. 

    Despite increases in gun sales, gun crimes continued to decrease in the United States for the Fifth straight year in 2011, according to the FBI Statistics from the FBI website.
    FBI data shows that crime rate has dropped 3.8% and the death by firearm is only 67.7%, the total number you see are all violent crimes not just firearms related but aggravated assaults, robberies, and murders together. In 2011, an estimated 12,664 persons were murdered in the United States. This was a 0.7 percent decrease from the 2010 estimate, a 14.7 percent decline from the 2007 figure, and a 10.0 percent decrease from the 2002 estimate. If you look at the FBI website you see that only 8,583 people die from firearms in this country, and 92% of those are all firearms that are illegally obtained and that means only around 601 of firearms deaths are caused by justifiable causes by self defense or law enforcement. At the same time that firearms murders were dropping, gun sales were surging. In 2009, FBI background checks for guns increased by 30 percent over the previous year, while firearms sales in large retail outlets increased by almost 40 percent. The number of applications for concealed carry permits jumped across the country as well.SO THIS REALLY TELLS US THAT, MORE LEGAL GUNS BEING OWNED BY LAW ABIDING CITIZENS DETER FROM CRIMINALS COMMITTING VIOLENT CRIMES. EXERCISE YOUR RIGHT, YOU NEVER KNOW WHEN YOU MIGHT NEED TO PROTECT YOUR SELF.

       Just very unrealistic to think that smaller mags will stop mass killings. Give someone a double barrel sawed off with #4 shot and they’d be able to kill far more with 4 blasts then someone with a semi auto could with 2 or 3 high capacity mags and in less time.

    I wholeheartedly support Rep. Metcalf for leading the way with HB 357.  1) it’s our Constitutional right 2) any restriction is eroding that freedom and creeping control 3) gun restrictions lead to gun bans which have proven time and again to result in tyrannical government 4) it’s not the job of the police to protect me 5) as a woman, I have no way to protect myself other than through firearms 6) criminals will never obey ANY gun laws (or any laws for that matter that stand between them and the crime they wish to commit) 7) the vast majority of gun owners are responsible, trained and practiced (I regularly go to the range) 8) limits on magazines are a recipe for danger to me…when faced with a real life situation, the accuracy of shots is not like at the range, you could be one handed, off balance, lying down anything but perfect, you need the maximum complement of shots to protect yourself 9) there is no such thing as “common sense” gun control 10) I’m a cop’s kid and my dad (if still alive) would be proud of me and what I’m writing here.

    I have had multiple background checks within the past year, all of which I passed. I own a firearm which came with two different size mags.. Banning what is legal to purchase is at present is crazy.. If you want to limit mags going forward talk to the manufactures who make them.. I am a law abiding Pennsylvanian and giving up my property ie a mag greater than 10 rounds,hell no not without replacements.. You supply me with 10 rounders first for free and maybe I’ll give them up.. Last thing, it takes 5 to 20 minutes to have police arrive when a crime is being committed,police can’t be every where. My gun can be with me all the time!

    my friends to vote.  I have
    observed first hand the effects of citizens being unable to defend themselves
    on three continents and in the City of Altoona, PA. 

     

    Any thought about restricting the rights of citizens to
    defend themselves or to enact wide-ranging gun control is at least without
    empathy. 

     

    I respectfully request that we start enforcing the laws we
    currently have, and take a serious stand against holes in the mental health
    system. 

     

    Restricting the rights of law-abiding citizens is contrary
    to common sense.  (ie taking cars
    away because of drunk drivers)  Any
    further impingement of the right to bear arms is a slippery slope and will lead
    to violations of the constitution of the United States.  (Which you and I swore to defend)

    Sen. Farnese is talking over representative Metcalfe and avoiding answering questions and muddying the waters with his lack of knowledge by his bombastic approach.  I have three basic questions:
     
    No credible research study, after the ban in 1994 that sunset in 2004, has shown that a ban on assault weapons have any value whatsoever and 37 states have shown a complete rejection of this approach by the sheriffs in those states and most of the sheriffs in Pennsylvania are opposed to this.  Why are you just stating the opinion of the international Association of Chiefs of police?
     
    1.      Your hypocritical viewpoint on the crime issues in Philadelphia is meant to distract people from the very real fact that you don’t care about the people being harmed there.  The fact is that our laws on straw purchasing and holding criminals accountable are being avoided by prosecutors in judges all around the state in the urban areas.  Nothing you have introduced has ever focused on that problem and neither have you said anything about the problem with mental health or the failures of the Pennsylvania State police to comply with the law.  Every police officer to have been killed in the state has been by criminal who had his firearms laws violations dropped in court as part of the plea bargain and yet you fail to address this.  Why!?
     
    2.      Philadelphia Council is currently in direct violation of the Pennsylvania preemption section 6120 with the laws they adopted in violation of the court consent decree they signed.  You have never said a word about local municipalities that have enacted their own laws in violation of the Pennsylvania law prohibiting (section 6120) why is that Sen.???
     
    3.      We currently have 128 pages of gun laws many of which are not enforced against career of violent criminals and yet we continue to focus on law abiding citizens instead of the process that turns these miscreants loose on the street!  Why is that Senator???
     
    In the end result Sen. you continue to focus on violating the Constitution that I’ve fought for as have many Pennsylvanians and you are an insult to the oath and the office of Sen. and you should be ashamed of yourself

    Thefederal governments powers are limited to Article I Section 8 of the US Constitution and the Ammendments. Nowhere in the US Constitution is the federal government given the power to regulate firearms ownership of citizens of the several states. Section 21 of the PA Constitution prohibits the state from regulating firearms ownership of the citizens of PA. So where does Senator Farnese have the right to sponsor a bill that is unconstitutional on both the federal and state level? If theses left wing marxists are so hell bent on attacking our individual rights, why don’t they do it legally with ammendments to both constitutions? Because they believe in sovereignty of the state and do not believe in sovereignty of the individual. They (the state) knows what is best for its citizens.

    Questions for the Senator, in response to his comments:
    1) You mentioned police officers being gunned down by the assault weapons you seek to ban, or “reasonably limit”.  Do you suppose the persons shooting these officers are the kind of citizens to be reasonably limited by your ban?
    2) Regarding the Attorney General’s Florida Permit position and your explanation of its obviousness.  Where do we witness the greatest use of the Florida Permit in Pennsylvania?  Could an additional/alternative explanation be that counties are not abiding by Pennsylvania’s Shall Issue law, thereby forcing law abiding citizens that should have received a PA permit to choose between (1) appealing and litigating their PA permit denial, which was wrongfully withheld or (2) to acquire a Florida Permit which has been recognized in this state, and from what I understand from Rep. Metcalfe requires passage of a more stringent review.
    3) You urged Rep. Metcalfe and others in his line, to “get with the program.”  I know that that’s what you want, and those in YOUR LINE.  The founding fathers of this country and this great state wanted me to have my guns, and to have that right unquestioned, BECAUSE THEY KNEW THAT’S WHAT YOU’D WANT.  They knew it is the tendency of a government to want people to get in line.  I don’t concern myself with what the majority says when it comes to my constitutional rights.  If the rights therein were subject to majority rule, they wouldn’t be in there!!  Get in line with the majority! How’d that work out in Germany.  This is called a crazy, extreme example.  What makes us think, as a people, that we have arrived where we are as a nation in a different way than any other, that we are somehow immune to the dangers and catastrophes that have befallen other nations throughout history.  We’ve been around ~220 years.  That is nothing.  The fool fails to learn from history.  I don’t know what you are to claim that we’re immune from it.

Leach (D) Phila wants to legalize marijuana….no wonder they also want to “protect” us with stricter gun laws!  They will be too stoned in Philly to know the business end of a firearm.  I’d much rather see sober gun owners than a bunch of stoners.  But then again, that’s a good way for a tyrannical government to take over… disarm and medicate the masses.

    It is unfortunate that Representative Metcalfe did not recognize that there was another guest on the program, an hour which was a disaster because of the Representative’s lack of manners and insistence that his opponent not be able to say anything.  Mr. Metcalfe would assert that the Second Amendment is like no other, that there are no limitations or restrictions that may be imposed, that the right to own an arsenal of weapons “cannot be questioned”.   Mr. Metcalfe’s supporters called the program, but they do not constitute the majority of the public.  President Obama was vilified for saying that rural Pennsylvanians “cling to guns”.  Representative Metcalfe’s response would be, “Oh, you bet we do, Mr. President!”  I am mortifed to identify as a Republican after watching this travesty.  I felt sorry not only for the distinguished State Senator Larry Farnese, but for the host, who had to tolerate Metcalfe’s attacks and boorish behavior. At the end of the program, host Schertzer referred to the guests as “gentlemen”.  There was only one gentleman on  the program.

    the sen kept saying there not comeing after our guns well if i have to have liability insurance in order to carry my gun guess what i cant afford liability insurance infact you did just take away my guns !!!! no matter what they are never going to get the guns out of the criminals hands so there for its my right to protect myself and my familly from those criminals because where i live the police force is small and the town and population are growing and seconds count and me haveing my guns gives me minutes !!!!

    After viewing your show ,it seem to me that Sen. Farnese was not prepared for this show. He had no useful suggestions or ideas. I doubt he knows which end of a rifle is the muzzle. Let big city officals deal with their own problems of crime first. Crook “will” always have firearm, what about the rest of us. I am sorry but Sen. Farnese was a joke…typical Democrat.

He’s running around like a chicken with his head off telling the American public that he can fix this problem by passing a few laws designed to eventually take the guns from law abiding citizens, He is a phoney and trying to make a name for himself on the backs of the dead children. You want gun control? Chicago has strict gun control and there were only 500 plus murders there last year.Is that gun control?
        As a former police officer for 12 years in the Cincinnati, Ohio area I can tell you that the big part of this problem is in the hearts and minds of sick people and unless you take away 100% of the guns in this country, someone will find a gun and kill someone. But even if you were to take away all the guns,…. look at the report in the Morning Call the very day of the Sandy Hook Tragedy, a Chinese man uses a box cutter to cut up 22 children at a school in China. Now China reports that after they took away all of the guns since 2010 people have been running around with knives cutting up children. at schools. How do you fix this Senator?

    Since Rep.Metcalfe repeatedly quoted the PA Constitution Article 1 Section 21:”The right of the
    citizens to bear arms in defense of themselves and the State shall not be
    questioned. ” Does he then also defend PA citizens rigth to have ANY type of weapon (automatic weapon, land mines on your property to combat intruders, etc)? If he does not defend the right to possess these types of weapons, HE is violating Artice 1, Section 21. If he DOES defend the right to possess and use these types of weapons, GOD HELP US!

      You should READ the laws.. no one can own these type of weapons without approval of the ATF ( that is Alcohol Tobacco and Firearms administration to the unknowing )… without going through a RIGOROUS background check, and lots of money….. It is the same as the Liberals saying ASSAULT WEAPONS… they are FULLY automatic ( meaning you pull the trigger ONCE and it keeps firing as compared to a semi-automatic which fires ONE bullet for EACH trigger pull… again for you UNKNOWING people)… The law has been defined as being able to have firearms COMPARABLE to the military… but since we cannot have a ASSAULT WEAPON ( again being FULLY automatic) semi automatic firearms are legal.  Read up on the definitions before you spout off with worthless and improper usage like the Senator for Philadelphia did….. And GOD HELP US if he gets HIS way or you can plan on defending your family and friends with a slingshot… if they allow that…. I WILL have a firearm to defend mine.. do what you will with yours………

    As an American (with) morals I’m sick to death of what we now have for government, I cry when I think about how many people have died to keep this country free from the beginning to now. They gave them selves to protech our country, our way of life, our freedom and our constitution!  Our government has betrayed all who came before and look forward to betraying those who stand at the ready to protect going forward.. Our government has become totally corrupt and the only thing they accomplish is based on either do-gooders or lobbiest’s which amounts to nothing less than buying Represenatives, Sentators, and Congressmen.  Lobbiest’s and do gooders rule our country not individuals who put our Constitution first and foremost. Our Constitution is the bond that has kept our Country strong and our people’s spirit strong. But with each modification to it has weakend it and our Country.

    If the doGooders and the government really want to turn the Country around and put a stop to the violence they would start looking at the root of the problem’s 1) The government and it’s lack of regard for the Constitution and twisting it to thier own good , 2) Put strong controls back in place to end the continuos violence on TV and Cable. 3) Make the meadia strat making movies and shows about good, about morals about family.    The children are tought by the TV today not by parents, they grow up seeing violence and playing games of violence and thats all!  The thing they miss in whatching all this violence is the realy reality and thye very real pain felt by the actions of the violence that is carried out on TV and in the games they play.  This they find out when they themselves try out what they see on TV and in games  and movies.    This is where time and money should be spent not taking away the rights given us by those that risked everything to provide us. Our Constitution has kept our Country alive leave alone that which isn’t broke and fix what is the, (the family unit) !   Stop and think – families visited and spent time with each other priot to changing the law’s to allow stores to open on Sundays !! Think about it.

    I am a disabled hunter. I have Idiopathic Poly Neuropathy. Therefore I can not feel anything with my hands. Under Pennsylvania law, with a Dr.’s recommendation, I am permitted to use a semi-automatic weapon to hunt with. I can not operate a bolt action or lever action rifle effectively. I therefore own and use a Knight Armaments SR-25 Carbine and a SR-25 Match Rifle. I use these semi-automatic rifles to hunt with, participate in 3 gun competitions, target shoot and for home defense.
    1.) SO THERE IS A NEED FOR A LAW ABIDING PERSON TO OWN A TACTICAL SEMI-AUTOMATIC RIFLE.

    Each of these rifles with optics are valued at $5,000.00 each. As I have a significant investment in these rifles:
    2.) I would like to be able to sell them to some other law abiding citizen should I or my estate no longer need them or to be able to pass them along to my son in later years.

    I sometimes hunt in the Bradford area. To travel there from Erie I can either use 2 lane US Rt 6 which is sometimes a 3 – 3 1/2 hour trip or travel across 4 lane and better maintained I-86. However, as of 2 weeks ago today, IF I continue to use I-86 to get to my hunting grounds through NY state I will be a disabled hunter FELON !!
    3.) Will I become a FELON in my own state?

    4.) Why is my Birth Certificate, Marriage Certificate, car registration, car license, drivers license and eventually my death certificate recognized by all fifty states and most other countries where as my LTC permit is not?
    WE NEED A NATIONAL UNIVERSAL LICENSE TO CARRY PERMIT OR A FEDERAL LAW THAT MAKES IT MANDATORY THAT ALL STATES RECOGNIZE ANOTHER STATES LTC PERMIT. Each state should retain the right to issue (or not) to its citizen and you should ONLY be able to obtain a LTC permit from your home state.

    5.) If I need a backround check to obtain a LTC Permit why do I need another  backround check to purchase firearm. A LTC PERMIT SHOULD ALSO BE A PURCHASE PERMIT.

    The way in which Metcalfe addressed Sen. Farnese was just  an abomination. Mr. Metcalfe appeared as no more than  a representative of the gun slinging, lawless, backward thinking, ‘Good Ol ‘Boy political prostrating,member of the NRA. No mr. Metcalfe you do not speak for all  decent folk in this country. I and many, many more stand behind our President Obama.

    When it was stated that Law Enforcement was for this ban on assault weapons. I noticed that the State Senator said The District Attorneys Association and the Chiefs of Police Association was who he was referring to.

    Both of these organisations are mostly political and not really Law Enforcement. 
    Chiefs are political appointees who rarely do any law enforcement duties and are appointed by the political organization who hired them and do i need say  anything more about District Attorneys and politics.

    The vast majority of down to earth officers on the street who actually enforce the laws are NOT for any new laws that will only effect the honest law abiding citizens. They are not the problem..

    If passing laws would solve the problem these mass murders would never have happened, after all its against the law to commit homicide

    Daryl Metcalfe is a Statesman and as such, he protects our rights and upholds the Constitution.  Politicians, like Larry Farnese, seek to usurp our rights, while making themselves ‘feel good’.  As a Daughter of the American Revolution, I shudder to think…had our ancestors been constrained by Farnese and his lot, we would still be subjects of the crown!  And, the Revolution was fought over a lot less governmental tyranny than what is imposed on us today.  Our ancestors were not enslaved by trillions of federal debt, billions of state debt and millions in local debt…let’s have Metcalfe’s back and primary the charlatans like Farnese.

      Oh yes, Counselor.  It is the mark of a statesman when one does not permit his opponent to speak.  Perhaps you would like to see a breakdown of how much time was seized by Mr. Metcalfe versus the words Senator Farnese was able to get in edgewise; it would be fascinating.  One would think that an attorney would be inclined to demonstrate a level of objectivity and fairness, but you see what you choose to see, you hear what you choose to hear without regard to reality: sad.

    the bottom line is this.. the second ammendment as all ammendments in the bill of rights are unalienable  meaning natural or GOD given rights that cannot be constitutionally infringed on by any government entity period. its not about hunting.., as a matter of fact when it was written if you didnt hunt you didnt eat gun or no gun..,and if you read James Madison  who authored the second ammendment  his intent if you really want to know was contrary to larry farneses comment was that the american people should have the same availability to munitions as the military have..,.. truth be told…now nobody is advocating that but the liberals and gun grabbers absurd and continual  attacks on  semi auto firearms,hi cap. magazines, and this obsesion for a national data base for all gun owners ( ie. universal backround checks)  is nothing more than incremental steps towards eliminating the second ammendment,and we all know that is exactly what they want i just wish they would admit it… unfortunately this country is populated by a lot of gullable imbeciles and low information voters and the propaganda machine ( mainstream media ) plays them like a cheap fiddle.

    It appears that some of my friends are some what offended by my “anti gun ban” comments and pics. I will not apologize for my beliefs nor will I stop my rants. I feel that after the last 20 years as a LEO I have earned my right to have an opinion…not to mention my right…your right as a citizen of the greatest country in the world! 
    I know for a fact that everyone who ever shot at me,did not stop down at the local gun store,go through the proper channel and obtain a gun permit from the local sheriffs office. I would and will say to a mathematical certainty that they all got them from places that you would not go!! Yet we as LEO’s do without second thought! I am certain that the ones bitching would shutter at the thought of where these guns are obtained! I am also certain you would change your mind about a lot of things if you went.The biggest reason I feel the way I feel is that if this were to happen it would be the beginning of the end of the constitution as we know it. I swore to uphold that 20 years ago and I take that oath more seriously than anything I have ever done in my life. If you did you may feel differently, However I doubt that you have ever done anything to defend anything in your life!!     poll numbers were interesting to say the least. I doubt they were as
    straight forward as the Senator (and maybe even the interviewer) wanted
    them to appear. I wish it would have been disclosed WHO was polled —
    real data like what areas of the state
    were polled, did the people actually live in those counties polled, how many people, range in incomes, occupations, ages and
    lastly do they feel they are a more conservative thinker or a more
    liberal thinker. Polls are very easily presented as supporting the views
    of the creator. I would not be surprised if the data was collected from
    a very tightly control call list in a large urban area or two. Too bad
    the opportunity was missed last night.

    I repeat my question which has yet to be answered: Since Rep.Metcalfe repeatedly quoted the PA Constitution Article 1 Section 21:”The right of the citizens to bear arms in defense of themselves and the State shall not be questioned. ” Does he then also defend PA citizens rigth to have ANY type of weapon (automatic weapon, land mines on your property to combat intruders, etc)? If he does not defend the right to possess these types of weapons, is HE not violating Artice 1, Section 21? If he DOES defend the right to possess and use these types of weapons, where will it end? Weapons for defense, YES. Background checks, YES. Enforce the laws we have, YES. Limit magazines to 10, YES.

      Thank you, commonsense.  You are appropriately named.  There is not much common sense on this thread nor was there much during last night’s program, in which the distinguished Senator Farnese was not permitted to speak.  The unwritten credo of the gun fanatics is, “We are afraid: afraid of government agents coming to our door en masse to enslave us and individuals coming to our homes to rob and destroy us.  We need weapons designed to kill multiple people in seconds in order to protect us and we are willing to accept the slaughter of innocent children on the altar of the Second Amendment, including the twenty angels that were slain in Newtown, Connecticut.  They are collateral damage..  Please forgive them, O God.

    I peesonally would like to know where these polls are, and who was questioned in them. I certainly wasn’t. I think the numbers lie. I just got off the phone with my local sheriff’s office to see status of my concealed permit and she told me they are swamped, they have taken in 63 applications already today. She also told me they mailed out 187 yesterday and another 112 mailed today. But the numbers are saying we want gun control?

    Thank you Daryl. To the communist rep from the city that bleeds. You have no clue how these guns work. My standard conceal carry gun comes with a 16 round magazine. The police carry a similar gun. The bad guys carry guns just like this. You expect me to have to take 6 rds out of my gun, or are you going to make my gun illegal? Additionally you might have some “yes men” police leaders who say they want this ban on normal guns. But I can tell you from first hand reports that most police don’t want this ban. They are not worried about good guys with guns, they worry about the bad guys… And guess what? The bad guys don’t follow the law.

    Sen. Farnese makes reference to all of these polls that allege support for more gun control laws yet he is unable to provide one credible reference to a single one.
    If you are so confident in your numbers, please provide references where your facts can be checked.

      Here are the results from a poll conducted by respected Quinnipiac University, announced February 1.  I suppose it will be written off as a liberal, Communist plot.:

      95% of those polled support universal background checks for those that wish to purchase firearms;

      60%  favor a ban on the sale of assault-style weapons (or whatever
      term one wishes to use for those firearms designed to slaughter human
      beings in rapid fire);

      59% support a prohibition on the sale of magazines with more than ten rounds;  and

      57%  favor stronger gun control laws in general.

        Polls really…..  I don’t follow polls at all, it all comes down to what maybe 1500 people being asked question.  Now where did they call, Philly, New York, or rural PA  Polls don’t mean anything to me either for or against.  The polls I want to see are the calls results the representivies are getting.  We don’t get to see those numbers.

    This gun debate has been going on since I was a child. I am 27 now, so we can all see how long that is. While owning my car is a hobby of mine, so are firearms. I own to defend myself, others and exercise my rights that were granted to me by being born a citizen of the US. Not only that but any person who wants to come to this country legally is extended the exact same freedoms if they decide to get a US citizenship. That is a great thing. Some of the people who come to this country want to get away from the fear of just living in their country. I have known a few Columbians, El Salvadorians, and Indians.

    I am in no shape a “dooms day prepper”, nor do I want to have to fend for my rights, because my Gov’t shouldn’t be attacking the rights this country was founded on. Everyone should know that the Second Amendment was not made to secure the right to hunt. It was developed for every free, able bodied citizen 18-45 to help secure the free state. Any person not active in the military is to be part of a militia. I hope I am not speaking to the choir.

    The problems we are facing now, are people demonizing weapons, and people with them as the demise of this nation. I beg to differ. I am a Veteran of 8 years, and I own an AR. It is a familiar rifle, and I like how I can customize it to me with various cosmetic parts, just like you can a car. Some of which enhance its performance, others just look “tacti-cool”. None of which increase its rate of fire, or lethality. Those parts are illegal. The only way they are legal is if you have gotten all the BATF paperwork filled out and accepted, and gotten the state police to accept it and paid another $200 in tax because that is how the “Gun-Control act of 1968″ made it legal. The act of 1964, is an updated version of the Assault weapons ban of 1934.

    We all should know that you cant actually go hunting with 100 round drums or 30 round magazines. That is actually dictated by each states regulations on hunting. Most states the limit is Five rounds. Some are actually Three. If you are caught, some states you get fined, lose your right to hunt indefinitely, and extreme cases your weapon is confiscated. A modern AR in most cases is a .223 caliber, smaller than a 1/4″. It’s released energy is only 1200 FT-Lbs at the muzzle. A .30 Cal hunting rifle, is 2500-3300 FT-Lbs. A .40 cal semi-automatic pistol is 450 FT-Lbs. A .223 is to small to humanely kill a deer, and thus deemed illegal to use by most states. In PA it has to be .270 or higher to be used on deer. They only allow bolt action rifles, and semi-auto shotguns(PA). Some states allow semi-auto rifles. Making the AR-10, .308 Caliber a good choice. Again the mag limit is dictated by the state.

    To give some perspective on the use of an AR-15 vs. the M16 or M4, I’ll talk rate of fire. If I were to load my rifle with a drum capable holding the rounds for this, and practice getting the speed down. My Semi auto rifle, and my finger could only manage probably 60 rounds in a minute. If I were to take the same ammunition feeding source and attach it to a M16 or M4 with the selector on burst, I could unload 600 at slowest. The last time I heard of anyone using a feeding source larger than 30 rounds was the 1990′s bank robbery, and the theater shooting. Of which the theater shooters drum failed to feed before 30 rounds. Along with that he was using a shot gun, and pistol. A 12ga. “00 Buck” shell holds nine, 9mm sized balls.

    I am in no way happy with how these incidents happen, but I am pointing out that the mass shootings were all by someone who had issues. Someone who wanted the attention that the media could give. We broadcast all of these horrible things almost instantly before any strait facts come out causing massive amounts of confusion and blame in the wrong ways. We make these shooters infamous with the attention we give them on mass media. After this shooting, everyone was quick to blame law abiding citizens. Quick to blame a rifle that was used, which was later recovered in the car, and the coroner found it was all handgun ammunition that caused the deaths. No rifle was used. And here we sit watching people on both sides battle it out over misinformation, instead of realizing they got caught up in a knee jerk reaction.

    This is the most touchy subject matter yet. I am a proponent of no “gun-control”. And this argument can go both ways. I am a legal owner. I have never had the desire to break the law and go do something like this. You can have thoughts, and “fantasies” about it. The minute you start to act on it in reality, you become a criminal. The only thing these gun bans, ban, is the law abiding citizen from defending themselves from someone who will not follow the rules. Example, I have a 10rd mag. because of the ban of higher cap mags. I followed the law and that’s all I have. A criminal breaks in with a 100 round drum. He didn’t follow the rules. I had better hope I can hit him sooner than he does me seeing as I am seriously out gunned now. I fire all 10 hitting him, he doesn’t go down due to the adrenaline rush(or pcp). He shoots me and leaves, then later bleeds out. I’m dead. If I didn’t follow the rules and had the same as him, and defended myself with the same firepower he had, won the shoot out, Id be going to jail.

    The hairy part about the law abiding citizen argument comes from the notion of a law abiding citizen “snapping”. But real statistics show that is not nearly the case. All these facts are being bent to the anti-gun agenda. Its clear when you look at the numbers from the FBI, our violent, to include gun crimes have been dropping. Knives have been going up…..

    In PA we have the castle doctrine, and stand your ground laws. Meaning at home, or out and about, someone is going to cause bodily harm to you or someone else, you have the right to stop them. By no means does this mean you can just used deadly force for a purse snatcher, and if you did, you would be prosecuted as if you intentionally murdered someone. This gives citizens the right to defend themselves and others lawfully in wait for the police to arrive on scene. Another argument comes about if you get road rage and kill someone. Your not getting away with it. Its not allowed. There has to be justifiable means. Getting angry is not. You walking along, hear a car start and floor it toward you, no doubt, at you, you have the right.

    I have been shooting since I was four years old. My parents both taught me how to carefully use and handle a firearm. Showed me what it could do. Shot water jugs and saw how they can severely mangle them. I respect any and all firearms from .17 cal(not just a bb gun) to .50 cal. My mother can shoot ping pong balls in a flowing creek. My father can shoot a fly at 400 yards. I competed in cowboy action shooting because it was fun. These days it would seem most parents teach children to be scared, or don’t show them at all. When I was growing up I remember all the times I had heard on the news another child killed them self or a friend because the parent left the house with a firearm loaded and out or “hidden” the child found it, and thought it was a toy. Mine, to include my parents when growing up, even now, they were/are always in a safe. I don’t blame movies, or games which unfortunately the NRA has mentioned. Being a member kind of upsets me that, that is the route they first took. I blame parenting. I blame the news media for such a harsh spin they have made. Guns are just as dangerous as your steak knife.

    The years of growing up I was keen to listen to the laws and rules, and saw how congress has tried their ways to limit what the law abiding citizen can have. They have tried limiting the caliber rifles you have because they are classified as sniper rifles. Tried outlawing handguns because they are to easily concealable. Now they try and outlaw these so called “assault weapons” or “weapons of war”. All because of misinformation.

    It is a dangerous concept when they refer to it as a “Weapon of War”. My hunting rifle is a Remington model 700. Same caliber as what is used by military snipers. My deer and waterfowl shotgun is a Remington Model 870. Same shotgun used by Infantry soldiers. Along with my Mossberg 500, used by Infantry as well. I have three “Weapons of War” in my possession. If you’ll notice, I didn’t mention my AR. That’s because it is a look alike of a weapon used by our Military. It is not allowed on the battlefield. It doesn’t have a selective fire feature. Safe, semi, burst or full auto, depending on model.

    If they go as far as to pass this new assault weapons ban Feinstein has proposed. Every Semi-Automatic weapon from pistol, to rifle, to shotgun, will be wiped from production. Read it, you should know just how “clear” legal writing is.

    So all I ask is if you or someone you know supports the Second Amendment, call, or write your reps, and show them your support even if they are anti. If they hear enough they may support it to. Encourage them. If you or someone you know does not support the idea of owning, or using a firearm, please encourage them to get into it, for defense, or fun, or at least, to stop trying to take our rights away because they don’t like the idea of firearms.

    I will respect someone if they don’t own because they don’t want to. As long as they don’t try and take mine away.

    Thank you Rep. Metcalf for your stance on our state and federal constitutional gun rights. Senator Farnese kept stating that the NRA was working with them (the Dems) on legislation. There are a whole lot of NRA members who are not happy with the NRA on some of there recent stances in regards to changing legislation at the federal or state level on gun control. If gun laws were the answer, Chicago, Philly and Pittsburgh should be the safest places in the country. Enforce the laws that are on the books

This has nothing to do with hunting. The Senator is telling me that banning a firearm over features like a pistol grip is common sense? Really? How is this common sense? Pistol grips haven’t hurt anyone. I am a lawful owner, I am responsible owner, and the Senator from Philadelphia will be affecting me with his infringement on my rights.

    I currently work for an FFL.

    I just finished testifying for a straw purchase, taking vacation time from my main employment.  I found that the useless judge dismissed the charges for both, even with a confession by the one.

    When our injustice system starts enforcing current laws, then maybe the illegal guns will be off the street.

    I am 110% behind Senator Metcalf’s “Firearms Protection Act” and hope more legislators sign on to it. After personally calling his office, I learned 58 lawmakers are on board with it… But there should be a lot more. Some lawmakers I’ve talked to say that “federal law trumps state law”…but in the case of unconstitutional laws, this is NOT the case as state law would nullify federal law.
    I don’t know about everyone else, but I’m getting fed up with liberal lawmakers trying to strip away our 2nd amendment rights just to disarm LAW-ABIDING CITIZENS. If you support Senator Metcalf’s HB357, call your representatives and let them know.
